Acceptance of Terms

By downloading, installing, or using the Dishula mobile application ("App"), you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree to these terms, do not use the App.

This Agreement constitutes a legally binding contract between you and Dishula, LLC ("Dishula," "we," "us," or "our"), a Florida limited liability company.

License Grant

Subject to your compliance with this Agreement, Dishula grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for your personal, non-commercial purposes.

Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are a minor, you represent that you have obtained the consent of a parent or legal guardian.

User Accounts

To access certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete registration information, including an accurate age range
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate this Agreement.

Third-Party Services

The App integrates with the following third-party services. By using the App, you agree to their respective terms of service and privacy policies:

  • Google Places API — for restaurant and location data (Google Terms of Service)
  • Supabase — for database, authentication, and file storage services
  • Vercel — for serverless infrastructure
  • Anthropic — for AI-powered content moderation
  • Resend — for transactional email delivery
  • Apple — for Sign in with Apple authentication
  • Google — for Sign in with Google authentication
  • Cloudflare Turnstile — for bot detection and CAPTCHA during authentication flows

Dishula is not responsible for the practices or content of these third-party services.

User Content

The App allows you to submit content including dish names, descriptions, ratings, reviews, photos, and optional profile information such as an Instagram handle ("User Content"). You retain ownership of your User Content.

By submitting User Content, you grant Dishula a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content within the App and in connection with promoting the App.

If you choose to add your Instagram handle to your profile, you grant Dishula the right to display it publicly within the App as a link to your Instagram account. You may remove your Instagram handle at any time through your account settings.

You represent and warrant that:

  • You own or have the necessary rights to submit your User Content
  • Your User Content does not infringe the intellectual property rights of any third party
  • Your User Content complies with the Community Guidelines in Section 7

Community Guidelines

You agree not to submit User Content that:

  • Contains hate speech, harassment, or content targeting individuals based on protected characteristics
  • Contains nudity, sexually explicit material, or graphic violence
  • Depicts illegal activity or encourages harm
  • Is spam, repetitive, or clearly off-topic
  • Impersonates another person or entity
  • Contains personal information about others without their consent
  • Is defamatory, false, or misleading
  • Contains photos that are not of food or restaurant-related subjects

Content Moderation

Dishula uses both automated and manual content moderation to review User Content for compliance with our Community Guidelines. Authorized Dishula administrators may access and review User Content and account information for moderation and platform integrity purposes. We reserve the right to remove any content that violates these guidelines, with or without notice.

Automated moderation systems are not perfect and may occasionally remove compliant content or miss violating content. You may report content you believe violates our guidelines using the reporting features in the App or by contacting us at privacy@dishula.com.

Reporting Violations

If you believe content in the App violates these guidelines, you have three ways to report it:

  • Report a dish — use the report option on any dish listing to flag inappropriate content or request deletion of a dish you submitted
  • Report a review — use the report option on any review to flag inappropriate content or request deletion of a review you submitted
  • Email — contact us at privacy@dishula.com with details of the violation

Content that violates these guidelines may be removed without notice. Repeated violations may result in a warning, temporary suspension, or permanent termination of your account. In cases involving illegal activity, we may report the activity to appropriate law enforcement authorities.

Deletion requests submitted by content owners (for dishes or reviews you created) are reviewed manually. We aim to process deletion requests within 7 business days.

Intellectual Property

The App, including its design, graphics, user interface, and underlying technology, is owned by Dishula and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer or decompile the App
  • Remove any proprietary notices or labels
  • Use the App to develop a competing service

Privacy

Your use of the App is subject to our Privacy Policy, available at dishula.com/privacy, which is incorporated into this Agreement by reference.

Disclaimers

The App is provided 'as is' and 'as available' without warranties of any kind, either express or implied. To the fullest extent permitted by law, Dishula disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Dishula does not warrant that: (a) the App will be uninterrupted or error-free; (b) defects will be corrected; (c) the App or its servers are free of viruses or harmful components; or (d) restaurant information obtained through the App is accurate or current.

Automated content moderation systems will not catch 100% of violations. Dishula is not responsible for user-generated content that slips through moderation.

Limitation of Liability

To the fullest extent permitted by applicable law, Dishula shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the App.

In no event shall Dishula's total liability to you for all claims arising out of or relating to this Agreement exceed the amount you paid to use the App in the 12 months preceding the claim (which, for a free App, is $0).

Indemnification

You agree to indemnify, defend, and hold harmless Dishula and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App; (b) your User Content; or (c) your violation of this Agreement.

Changes to This Agreement

We may update this Agreement from time to time. We will notify you of material changes by updating the 'Last Updated' date and, where appropriate, through in-app notification. Continued use of the App after changes constitutes acceptance of the updated Agreement.

Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Boca Raton, Florida.
